TERMS OF SERVICE

1. OVERVIEW
This website, sapsuckers.ca, is operated by Sapsuckers® ("we", "us", "our"), based in Markham, Ontario, Canada. By visiting the site or buying from us, you agree to these Terms of Service, along with our Refund Policy, Shipping Policy and Privacy Policy, which are part of these terms. If you don't agree, please don't use the site.

2. ELIGIBILITY
You must be at least the age of majority in your province, state or country to place an order, or have permission from a parent or guardian who agrees to these terms.

3. PRODUCTS
Our apparel, drinkware and gear are made to order by our print partner. Our Maple Syrup Kits are assembled by hand in Markham, Ontario. We do our best to show colours and details accurately, but screens vary and slight differences in colour, print placement and materials are normal. Kit contents may occasionally be substituted with components of equal or better quality.

Maple Syrup Kits are intended for adults. Tapping trees and boiling sap involve heat, sharp tools and outdoor work. Follow the included instructions, only tap trees you own or have permission to tap, and never boil sap indoors without proper ventilation. You use the kits at your own risk.

4. PRICING AND PAYMENT
Prices are shown in Canadian dollars unless otherwise stated and may change without notice. Applicable taxes are added at checkout. Payment is charged when you place your order. We may refuse or cancel any order, including orders that appear fraudulent or were placed at an obviously incorrect price; if we cancel an order you've paid for, we'll refund you in full.

5. ORDERS AND SHIPPING
Maple Syrup Kits ship within 3-5 business days of your order. Apparel and gear are produced and shipped separately, usually within 2–5 business days. Delivery times are estimates and not guaranteed. Full details are in our Shipping Policy: https://sapsuckers.ca/policies/shipping-policy

Orders shipped to the United States include U.S. import tariffs and prepaid duties in the shipping price shown at checkout, so there is nothing further to pay on delivery. If the tariff actually charged is lower than what you paid, we will refund the difference.

Risk of loss passes to you when your order is delivered to the carrier-confirmed address. If a package is lost in transit, contact us and we'll work with you to trace or replace it.

6. CANCELLATIONS, RETURNS AND REFUNDS
Because every order is made or packed for you, we do not accept returns or exchanges for change of mind, including sizing. You may cancel for a full refund before your order ships. 7. DISCOUNT CODES AND PROMOTIONS
Discount, referral and affiliate codes have no cash value, cannot be combined unless stated, may expire, and may be withdrawn at any time. We may cancel orders that misuse codes.

8. INTELLECTUAL PROPERTY
Sapsuckers®, our logos, slogans, designs, product names (including The First Tap™ and The Triple Tap™), photos and site content belong to us and are protected by trademark and copyright law. You may not copy, reproduce or sell them without our written permission.

9. REVIEWS, COMMENTS AND SUBMISSIONS
If you send us reviews, photos, comments or ideas, you give us permission to use, edit and share them in connection with our business, without payment. You're responsible for what you submit and confirm it is yours to share and isn't unlawful, offensive or misleading. We may remove any submission at our discretion.

10. PROHIBITED USES
You may not use this site for any unlawful purpose, to infringe anyone's rights, to upload malicious code, to scrape or harvest data, to interfere with the site's security, or to submit false or misleading information.

11. THIRD-PARTY SERVICES AND LINKS
Our store runs on Shopify, and orders are fulfilled with help from third-party print, shipping and payment partners. We aren't responsible for the content or practices of third-party websites we link to.

12. ACCURACY OF INFORMATION
We try to keep everything on the site accurate and current, but errors can happen. We may correct errors, inaccuracies or omissions, including in pricing and availability, and update information at any time without notice.

13. DISCLAIMER
Except as required by law, the site and products are provided "as is" and "as available" without warranties of any kind. We don't guarantee any particular syrup yield or result from our kits; that depends on your trees, weather and technique.

14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Sapsuckers® and its owners, partners and suppliers are not liable for any indirect, incidental, special or consequential damages arising from your use of the site or products. Our total liability for any claim is limited to the amount you paid for the product involved. Nothing in these terms limits any rights you have under Ontario consumer protection law or other laws that cannot be waived.

15. INDEMNIFICATION
You agree to indemnify and hold Sapsuckers® harmless from any claims arising from your breach of these terms or misuse of the site or products.

16. GOVERNING LAW
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.

17. CHANGES TO THESE TERMS
We may update these terms at any time by posting the new version on this page. Continued use of the site after changes means you accept them.
